Terms of Service & Workshop Agreement

1. Scope of the Software Service

GaragePulse is a cloud-edge Software-as-a-Service (SaaS) platform designed for automotive workshop recordkeeping, job card management, technician allocation, digital invoicing, vehicle history tracking, and inventory control.

Automotive Repair Independence: GaragePulse provides software tools only. Apollos Digital Solutions is not an automotive repairer, parts manufacturer, or insurer. All diagnostic advice, repair work quality, pricing negotiations, and customer warranties are strictly the responsibility of the individual garage owner.

2. Wallet Billing & Service Lockout Policy

• Prepaid Utility Model: Access to the platform is billed on a usage-based prepaid model (e.g. KSh 50/day on Mtaani tier, KSh 99/day on Garage tier, or monthly fixed enterprise rate).
• Daily Deductions: Usage fees are deducted automatically by the daily deductor service for active workshops. Active free trial promo periods waive daily deductions until their expiration date.
• Automatic Service Interruption: If a garage wallet balance drops to zero or below, the system automatically transitions into a “Locked” state. While locked, dashboard creation actions are suspended until the account is topped up. Data is never deleted due to temporary lockout.

3. Customer Data & Vehicle Records Ownership

You Own Your Data: You retain full ownership of all customer profiles, vehicle inspection photographs, job card records, and invoice histories you enter into GaragePulse.

We grant you an exportable, non-exclusive right to extract your workshop data at any time in standard CSV/PDF formats. We will never sell or rent your customer lists to third-party parts distributors or competing workshops.

4. Limitation of Liability

To the maximum extent permitted under Kenyan Law, Apollos Digital Solutions shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, garage business interruption, loss of vehicle diagnostic data, or equipment failure.

Our maximum cumulative liability for any claim arising out of or related to this agreement is strictly limited to the total subscription fees paid by you to GaragePulse over the preceding three (3) months.

5. User Conduct & Prohibited Uses

You agree not to:

• Use the platform to forge fraudulent inspection documents, alter vehicle mileage records, or register stolen vehicles.
• Attempt to reverse-engineer, decompile, or bypass Row Level Security policies of the database.
• Share administrative credentials across unauthorized third parties.

6. Governing Law & Dispute Resolution

These terms are governed by and construed in accordance with the Laws of the Republic of Kenya. Any controversy, claim, or dispute arising out of this agreement shall be submitted to the jurisdiction of the competent courts of Nairobi, Kenya.
