This agreement is between Apollos Digital Solutions ("We", "Us") and You ("The Garage Owner"). By using GaragePulse, you agree to these terms.
We provide GaragePulse "as is". We do not promise it will be perfect, bug-free, or online 100% of the time. While we try our best to keep the lights on, we are not responsible for any lost sales, business interruptions, or data errors caused by system downtime or bugs.
To the maximum extent permitted by Kenyan law, Apollos Digital Solutions' total liability to you for any claims arising out of or relating to these terms or your use of the service is limited to the amount you paid us in the last 12 months (or KSh 5,000, whichever is lower).
In simple terms: If we mess up completely, the most we will refund you is the money you paid us this year. We are not liable for millions in lost potential revenue.
You agree to indemnify and hold harmless Apollos Digital Solutions from any claims, damages, legal fees, and costs arising out of your use of the service.
This means if you use GaragePulse to store illegal data, send spam, or conduct fraudulent activities, and we get sued or investigated because of it, you are responsible for paying our legal fees and any resulting damages.
We operate on a prepaid wallet basis. We reserve the right to suspend access to the service immediately if your wallet balance is zero or negative.
Service restoration is contingent upon topping up your wallet. We are not liable for any data inaccessibility during periods of suspension due to non-payment.
These terms are governed by the laws of Kenya. Any disputes arising from this agreement will be resolved in the courts of Nairobi.
